    The nomination of Sonia Sotomayor for the Supreme Court prompted discussion about our use of “Hispanic,” “Latino” and related terms. It’s not a simple issue, and I consulted with a number of reporters and editors here who offered good counsel.

    Here are some key points to keep in mind:

    • While both “Latino” and “Hispanic” are generally acceptable, some people have a strong preference. We should respect those preferences as much as possible in referring to individuals and groups; reporters and editors should routinely ask.

    • Specific references like “Puerto Rican” or “Mexican-American” or “Guatemalan immigrant” are often best.

    • Judge Sotomayor clearly uses “Latina” for herself, and we should respect that preference whenever feasible. In more detailed references, we can note that her parents moved to New York from Puerto Rico. Once again, remember: they were not immigrants.

    • In describing one distinction she would attain if confirmed, I think we have to say she would be “the first Hispanic justice,” despite her own use of “Latina.” Calling her “the first Latina justice” isn’t quite what we mean, and several people I consulted agreed that calling her “the first Latino justice,” while perhaps grammatically defensible, seems awkward or wrong.

    • I will adjust the current entry in The Times’s stylebook to clarify that “Latina,” like “Latino,” can be used as an adjective as well as a noun. We should be aware, though, that for many English speakers the use of inflected adjectives may still be unfamiliar.

    • As always, references to ethnicity should be used only when they are pertinent, and the pertinence is clear to readers. One reporter pointed out that many second- and third-generation Latinos regard themselves as simply “American” or “Texan” or whatever. If ancestry is relevant, phrases like “a lawyer of Mexican descent” or “a New York native of Puerto Rican descent” might serve.

    • Our stylebook defines “Hispanic” as “descended from a Spanish-speaking land or culture.” But be aware that opinions vary on how broadly to apply these terms. Can “Hispanic immigrants” describe a group that includes Brazilians or other Portuguese speakers? Can “Hispanic” describe immigrants from Spain itself? Once again, being specific will help minimize confusion or ambiguity.

    • We should avoid constructions like “President Obama has nominated Judge Sotomayor to be the first Hispanic justice on the Supreme Court,” or “Judge Sotomayor is hoping to become the first Hispanic justice.” That phrasing suggests that their primary goal is to have a Hispanic justice. We can note the potential distinction parenthetically: “Judge Sotomayor, who would be the court’s first Hispanic justice, …” (Similarly, during the presidential campaign, we tried to avoid phrases like, “Senator Obama is campaigning to become the first African-American president” — that wasn’t the point of his campaign.)

    A brief report from the Pew Hispanic Center offers some interesting background (including more on the Cardozo question). Here’s one section:


    Q. How do Hispanics themselves feel about the labels “Hispanic” and “Latino”?

    A. The labels are not universally embraced by the community that has been labeled. A 2006 survey by the Pew Hispanic Center found that 48% of Latino adults generally describe themselves by their country of origin first; 26% generally use the terms Latino or Hispanic first; and 24% generally call themselves American on first reference. As for a preference between “Hispanic” and “Latino”, a 2008 Center survey found that 36% of respondents prefer the term “Hispanic,” 21% prefer the term “Latino” and the rest have no preference.

    Q. What about Puerto Ricans? Where do they fit in?

    A. Puerto Ricans are U.S. citizens by birth — whether they were born in New York (like Judge Sotomayor) or in the Commonwealth of Puerto Rico (like her parents). According to the Census, some 97% of all persons born in Puerto Rico and living in the mainland United States consider themselves Hispanics. Overall, Puerto Ricans are the second largest group of Hispanics in the 50 states and District of Columbia — they make up 9% of the mainland Hispanic population, well behind the Mexican-origin share of 64%, but ahead of the 3.5% share of Cubans. In 2007, the 4.1 million persons of Puerto Rican origin living in the mainland United States exceeded Puerto Rico’s population of 3.9 million.

    Trayvon Martin: Special prosecutor appointed in Trayvon Martin shooting case

    Florida Gov. Rick Scott and Attorney General Pam Bondi today appointed a special prosecutor to investigate the shooting death of Trayvon Martin, removing the state attorney who had been considering the case, they announced tonight.

    Scott and Bondi appointed State Attorney Angela B. Corey, whose office handles cases in Duval, Clay and Nassau counties.

    Brevard-Seminole State Attorney Norm Wolfinger relinquished the investigation after a talk today with Scott and Bondi, according to a statement from the governor's office. The substance of the conversation was not disclosed.

    It's unclear whether a grand jury that was scheduled to meet April 10
    Pat Whitaker chief of operations in the State Attorney's Office in Seminole County, said it's possible the special prosecutor will still bring the case before the grand jury.

    "That's up to her [Corey]," Whitaker said. "We have one [grand jury] summoned."

    Hundreds of students at Miami's Carol City High School held a massive walkout Thursday afternoon to protest the Trayvon Martin shooting.

    Police said about 300 to 400 students were estimated to have taken part in the protest. Aerial footage showed students pouring into the streets outside the school at 3422 Northwest 187th Street in Miami Gardens around 12:30 p.m.

    Students told NBC 6 that Martin attended the school for two years, but that could not be confirmed immediately with the school board. They also added that it was a Facebook-driven march and that teachers let them leave.

    The students chanted "What do we want? Justice. When do we want it? Now." Some carried ice tea and Skittles, which was what Martin had gone to buy at a nearby convenience store when the shooting occurred.

    "It's a bunch of kids, walking around screaming justice for Trayvon cause that's what we need. We are going to get it. If we don't get no justice there ain't going to be no peace," Alysa Robinson, a 10th grader said.


    Miami Gardens Police spokesman Carlton Coleman said the school's principal approved the demonstration which started on campus and quickly spilled onto the streets. School officials said the children weren't given permission to leave the school.

    "We want justice," said Linda Kelley, an 11th grader.

    The protest brought traffic on nearby streets to a standstill as students marched down streets for several blocks, chanting and pounding on car hoods.

    Miami Gardens Police cars were at the scene along with Miami-Dade School Board police.

    "We are just there as a presence," Coleman said.

    By around 1 p.m. many of the students began making their way back towards the school. Some gathered at a nearby recreation center.

    Officials at the school didn't immediately comment. Miami-Dade Public Schools spokesman John Schuster said Martin's mother, Sybrina Fulton, had called the school's principal and told him to tell the kids not to do this sort of thing.

    Martin, 17, was shot and killed by neighborhood watch volunteer George Zimmerman on Feb. 26 in Sanford.

    Zimmerman told police the shooting was self-defense, and no charges have been filed in the case.

    Just hours before Rev. Al Sharpton was to hold a rally in Sanford, the city's police chief, Bill Lee Jr. temporarily removed himself from the position because he said he had become a distraction to teh investigation into the shooting.

    "The temporary step-down of Bill Lee is nothing," said Tracy Martin, the teen's father. He was with Sharpton when he said he wants the man who shot his son to be arrested and convicted.

    Sharpton is the host of "Politics Nation" on MSNBC, which is also owned by NBC Universal.

    Thursday night's rally is just one of many being held across the country over the past week following the shooting of Martin

    In Liberty City Wednesday night, dozens of people marched at Sherdavia Jenkins Peace Park in support of the Martin family.

    Martin's parents were in New York's Union Square Wednesday night for a rally dubbed the Million Hoodie March. Martin was wearing a hoodie at the time of the shooting.

    During a Wednesday evening meeting, the Sanford City Commission voted 3-2 that it had no confidence in Chief Lee over his handling of the Martin shooting.

    The Florida state attorney for Seminole County announced Tuesday that a grand jury would be investigating the case. The U.S. Justice Department and the FBI announced on Monday that they had also begun an investigation into the shooting.
